Man accused of stealing liquor remanded

ST CATHERINE, Jamaica — A St Catherine man found himself in trouble with the law after he allegedly stole a pack of biscuits and four bottles of liquor from a Rubis service station in Spanish Town.

Mark Thomas, on Tuesday, pleaded not guilty to a charge of simple larceny and was remanded into custody until February 17 when his case will again be mentioned.

Thomas was arrested after workers say they saw him leaving the convenience store of the service station with two bottles of Guinness, two bottles of Dragon stout, a bottle of cooking oil and a pack of Nibble biscuits.

“How do you know that the items were removed,” Resident Magistrate Natalie Brooks asked the complainant, who responded that the man did not have a receipt and that he confessed to taking the items.

However, Thomas told the court that he bought the bottles of stout from a street vendor and the cooking oil from a wholesale.

“Do you have any other matter before the court?” the magistrate asked.

“No,” Thomas replied, before informing the court that he had previously been before the Corporate Area Resident Magistrate’s Court on a similar matter.

Farmer accused of stealing from other man’s farm

KINGSTON, Jamaica—A farmer is to be tried in the Corporate Area Resident Magistrate’s Court on November 4 on a charge of praedial larceny.

The date was set when farmer Omar Brown appeared in court on Wednesday. He pleaded not guilty and his bail was extended.

Brown was reportedly caught by the complainant before daybreak, on September 23, uprooting scallion from his St Andrew farm.

On Wednesday, the court ordered that Brown be fingerprinted.

Teen fined for stealing policewoman"s chai

A teen who stole jewellery belonging to a female police officer was rescued by his mother, who paid $20,000 in compensation on Friday after he was hauled before the Corporate Area Resident Magistrate’s Court.

Charged with larceny from the person is Christopher Gordon, who pleaded guilty to committing the robbery.

The court was told that Gordon grabbed the female officer’s chain and pendant and ran.

He was chased and held by a police on bike patrol.

The chain, which was returned, is valued at $105,000, while the missing pendant cost $12,000.

Gordon’s mother, who was present in court, informed senior resident magistrate Judith Pusey that she will pay for the pendant and repairs to the chain, amounting to $20,000.

“Is he a good boy?” asked RM Pusey.

Gordon’s mother said, “He is, Your Honour. I don’t know how he got into this.”

Gordon was then sentenced to nine months suspended for three years.

RM Pusey said, “Since he is a good boy, I shouldn’t see him come back in here in three years or he will have to serve his sentence.”

Six fined for stealing water

Six persons were convicted in the Portmore Resident Magistrate’s Court recently for trespassing on the works of the National Water Commission (NWC).

According to the NWC, the accused, Nathalie Miller, Barrington Barnes, Pauline May Smith, Jennifer Rowe and Kedow Williams of Portmore and Greater Portmore, St Catherine, addresses, were all found guilty and charged a fine of $8,000 or spend 30 days in prison.

Nicole Monique Gray, also from a Portmore address, was fined $8,000 or spend 10 days in prison.

The NWC is reminding persons who continue to trespass on its network that once caught, they will be prosecuted and made to pay outstanding sums, which might have accured as a result of illegal activities.

The NWC also stated that they are willing to enter into any reasonable payment arrangement to ensure customers settle outstanding balances and to facilitate the regularisation of previous illegal connections.

A man who the police accused of stealing a battery was freed in the Spanish Town Resident Magistrate’s Court yesterday, following a successful no-case submission by his attorney.

Dwayne Gardener, 35-year-old construction worker of Portmore, St Catherine, was before the courts on a charge of larceny.

When the matter was mentioned, attorney-at-Law Vincent Wellesely told the court that the accused could not be prosecuted as charged.

He explained that the Crown was depending on the written statement of a representative for Digicel, which states that the battery found in his client’s possession are supplied to both his company and LIME Jamaica limited.

Wellesley said that the statement should be sought from Product Solutions Limited to identify the true owner of the battery in question.

The clerk of court then conceded that there was a flaw in the Crown’s case which resulted in Gardener being freed.

Allegations are that on October 15, last year, the accused was stopped by the police along the Braeton main Road in St Catherine.

While his documents were been checked, the police observed a battery he determined was the property of Digicel Jamaica.

The accused was then charged with larceny, he made several court appearances and has maintained his innocence throughout.

Cop accused of stealing money during operation gets bail

A cop who is accused pocketing $30,000 during a police operation was granted $100,000 bail when he appeared in the Corporate Area Resident Magistrate’s Court yesterday.

Frederick Morant, who is attached to the Organised Crime Investigation Division (OCID), is to return to court on August 26, for trial.

Allegations are that on June 20, about 3 p.m., police officers were carrying out an operation at a wholesale on Waltham Park Road in Kingston for uncustomed goods.

It is alleged that during the search, the owner of the establishment was present and claimed that she lost $30,000 that was hidden under a mattress.

The court heard that Morant’s colleagues noticed him acting suspiciously and notified their supervisor.

It is alleged that during a search of Morant, the cash fell from one of his pockets.

Morant, who has denied the allegations, is to surrender his travel documents as a condition of his bail.

Men fined for stealing cleaning agents

Two men, accused of stealing quantities of cleaning agents from a businessman, were each fined $50,000 in the Corporate Area Resident Magistrate’s Court on Wednesday.

Charged with simple larceny are Anthony Robinson and Jason Ashmeade. Ashmeade was also charged with possession of an offensive weapon.

The Crown alleges that, Robinson and Ashmeade allegedly stole floor polish, dishwashing liquid, fabric softener and bleach, along with two boat engines. The items are reportedly valued at $321,500.

The attorney representing both men urged Senior Resident Magistrate Judith Pusey to be lenient and grant a non-custodial sentence.

“They have accepted responsibility for what has transpired. They have never been in trouble with the law,” he said.

However, Pusey expressed a different view, arguing that the men should be sent to prison.

“They are a number of small businesses struggling to survive, and they chose to pilfer. They must feel the sweet taste of the law,” she said.

The RM fined both men and ordered that Ashmeade pay $4,000 for possession of a knife.

JN worker fined for stealing

After making restitution for stealing over $300,000 from her employer the Jamaica National Building Society, Tamra McCaulsky was fined a total of $120,000 in the Corporate Area Resident Magistrate’s Court Monday.

McCaulsky, 33, from Portmore, St Catherine, was an Administrative Clerk at the bank. she was charged with two counts of larceny as a servant.

Her attorney, in a bid to get a reduced sentence, told the court that McCaulsky, “acknowledged what she did was wrong and did not waste the court’s time. She was arrested on February 13 and pleaded guilty on March 7, she also made restitution and she is the mother two”.

Senior Resident Magistrate Judith Pusey stated, “A person who steals to maintain a lifestyle should go to prison. When a person steals to maintain a lifestyle, it is wrong.”

RM Pusey fined her, $50,000 for the first count of larceny as a servant, $30,000 for the second count, $20,000 or six months for unauthorised access to computer data and another $20,000 or six months for making unauthorised transactions.

JUTC driver on trial for stealing $650

A Jamaica Urban Transit Company (JUTC) driver is to face trial on June 30, after he was accused of stealing $650.

Jermain Welch, who appeared in the Corporate Area Resident Magistrate’s Court last Friday, pleaded not guilty and had his bail extended.

Allegations are that during a random inspection of tickets on a bus that Welch was driving, revenue officers found several discrepancies involving the bus tickets that he was issuing to passengers.

It is alleged that while the accused was being inspected, he ran from the bus with the cash and was chased by JUTC officials.

When asked why he ran from the bus with the cash, Welch told the court that he was intimidated by the JUTC officials. “It was not strange for them to find those tickets on me, but I was intimidated, and one of the supervisors came over me and said dat if him find a dollar over, me a go prison,” the accused said.

Senior Resident Magistrate Judith Pusey, who was listening keenly to the accused, said because he ran, that raised suspicion.
