JOHANNESBURG, South Africa (CMC) — Captain Darren Sammy will part with 20 per cent of his match fee for West Indies’ slow over rate during Sunday’s second Twenty20 International at the Wanderers.

The fine was imposed by match referee Ranjan Madugalle after West Indies were deemed to be one over short at the cut-off time for the innings.

The Windies players were also fined ten per cent of their match fees for the offence.

Sammy accepted both the charge and the fine, negating the need for a formal hearing.

If West Indies breach the over-rate rule within the next 12 months, Sammy will be slapped with a one-match suspension.

West Indies pulled off the highest ever run chase in T20 Internationals on Sunday to beat South Africa by four wickets with four balls to spare.

Reus fined record Eur540,000

BERLIN, Germany (AFP) — German international Marco Reus has been slapped with a record EUR540,000 ($665,000) fine for driving without a licence, the daily Bild reported yesterday.

“Today I know it: I was much too naive in this situation, it was a stupidity I have learned from,” said the 25-year-old.

“I’ve learned my lesson it will never happen again.”

According to Bild, the fine is a record in Germany for such an offence.

The Borussia Dortmund player, who is currently out with a right ankle injury, was stopped by police on March 18 behind the wheel of a luxury car as he returned from training.

He failed to present his licence to police who later discovered that he did not possess one and he had been stopped five times previously between September 2011 and March 2014.

Each time Reus picked up a fine without anyone checking his licence.

The fine was calculated in proportion to his revenue which the court estimated at 180,000 euros ($221,000) a month.

Reus has only played 11 games this season but is expected to return from injury in January.

Stone thrower fined $50,000 for wounding

ST CATHERINE, Jamaica — A woman, who pleaded guilty to hitting another with a stone, was slapped with a $50,000 fine when she appeared in the Spanish Town Resident Magistrate Court.

Tisa McPherson was sentenced Tuesday after pleading guilty to a charge of unlawful wounding.

Allegations are that on December 7 the complainant was on her way home when an argument developed with the accused. A stone was used to hit the complainant.

The court was not told the reason for the argument or the location where the incident occurred.

McPherson is to serve six months behind bars if the fine isn’t paid.

KINGSTON, Jamaica — A man was fined $10,000 in the Corporate Area Resident Magistrate’s Court after pleading guilty to assaulting another with a coconut.

Keno Bailey pleaded guilty to a charge of wounding with intent.

After pleading guilty, Bailey attempted to justify his action telling the court that he flung the coconut to ward off an attack by the complainant on his (Bailey’s) cousin.

He is to serve six months behind bars if the fine isn’t paid.

Cell phone thief fined $20,000

A 19-year-old construction worker who robbed a female complainant of her cell phone was fined $20,000 or ordered to serve six months imprisonment in the Corporate Area Resident Magistrate’s Court on Wednesday.

Charged with simple larceny is Andrew Walker.

The court heard that on the day of the incident, the accused robbed the complainant of an Alcatel cell phone and as he tried to escape was chased by persons. He was later seen by the police and apprehended.

His attorney begged Senior Resident Magistrate Judith Pusey for leniency.

“What caused you to do it?” the magistrate asked.

“I really never want to do it,” he responded.

“I promise, I won’t do it again. I swear, I won’t do it again,” he added. The magistrate then told him, “Yield not to temptation for yielding is sin. If I could sing I would sing it for you.”

Teen fined for stealing policewoman"s chai

A teen who stole jewellery belonging to a female police officer was rescued by his mother, who paid $20,000 in compensation on Friday after he was hauled before the Corporate Area Resident Magistrate’s Court.

Charged with larceny from the person is Christopher Gordon, who pleaded guilty to committing the robbery.

The court was told that Gordon grabbed the female officer’s chain and pendant and ran.

He was chased and held by a police on bike patrol.

The chain, which was returned, is valued at $105,000, while the missing pendant cost $12,000.

Gordon’s mother, who was present in court, informed senior resident magistrate Judith Pusey that she will pay for the pendant and repairs to the chain, amounting to $20,000.

“Is he a good boy?” asked RM Pusey.

Gordon’s mother said, “He is, Your Honour. I don’t know how he got into this.”

Gordon was then sentenced to nine months suspended for three years.

RM Pusey said, “Since he is a good boy, I shouldn’t see him come back in here in three years or he will have to serve his sentence.”

Briton fined for smuggling cocaine in panty

A British resident was hauled before the Corporate Area Resident Magistrate’s Court yesterday after she was held recently leaving the island with a quantity of cocaine in her panty.

Charged with possession of, dealing in, taking steps to export and conspiracy to export cocaine is Lavine Nicholas.

Nicholas pleaded guilty to all four counts. The drug weighed one pound six ounces in total.

She was fined $150,000 or six months for possession, $200,000 or six months for dealing in $300,000 or six months to run consecutively, plus 18 months and 12 months for conspiracy, to run consecutively.

The court was told that Nicholas was held while on her way to England.

When asked by RM Judith Pusey why she shouldn’t go to jail for the crime, Nicholas said, “Your Honour, apart from being stupid, I was being influenced by someone.”

Nicholas’ fingerprints were also taken.

Six persons were convicted in the Portmore Resident Magistrate’s Court recently for trespassing on the works of the National Water Commission (NWC).

According to the NWC, the accused, Nathalie Miller, Barrington Barnes, Pauline May Smith, Jennifer Rowe and Kedow Williams of Portmore and Greater Portmore, St Catherine, addresses, were all found guilty and charged a fine of $8,000 or spend 30 days in prison.

Nicole Monique Gray, also from a Portmore address, was fined $8,000 or spend 10 days in prison.

The NWC is reminding persons who continue to trespass on its network that once caught, they will be prosecuted and made to pay outstanding sums, which might have accured as a result of illegal activities.

The NWC also stated that they are willing to enter into any reasonable payment arrangement to ensure customers settle outstanding balances and to facilitate the regularisation of previous illegal connections.

Firearm owner fined $50,000 for negligence

A man who left his licensed firearm in his motor car, resulting in it being stolen, was ordered to pay a fine or face imprisonment when he appeared before the Corporate Area Resident Magistrate’s Court on Tuesday.

Charged with loss of a firearm through negligence is Wayne Wray.

The allegations are that on June 3, at approximately 8:30 p.m., Wray parked his motor car outside a premises at Acadia Drive, Kingston 8. On leaving his car, Wray reportedly placed his gun inside his briefcase, which he placed under the driver’s seat, leaving the vehicle to enter a building. It is reported that on his return, Wray discovered that the rear window of his vehicle had been shattered. The briefcase containing the firearm, along with several other valuables was taken from the vehicle.

The court heard that security camera footage of the robbery in progress was handed over to police personnel as evidence.

During the proceedings, Wray’s attorney called three witnesses to the witness stand, all of whom gave glowing testimonies about the character of the accused.

“He is a law-abiding Christian citizen, … always cognisant of the law, and has a tradition in his family of legal officers,” said one witness.

“Wayne is somebody whom I have the highest regard for … I know he is most honourable. Someone who is most committed to doing things that are good, and right and decent,” said another.

Seemingly quite impressed with how three diverse witnesses could speak so glowingly about the accused man’s character, Senior Resident Magistrate lauded Wray, noting that the incident appeared to be a momentary lapse of judgement.

Subsequently, the sitting magistrate ordered Wray to pay a fine of $50,000 or serve six months in prison.

Men fined for stealing cleaning agents

Two men, accused of stealing quantities of cleaning agents from a businessman, were each fined $50,000 in the Corporate Area Resident Magistrate’s Court on Wednesday.

Charged with simple larceny are Anthony Robinson and Jason Ashmeade. Ashmeade was also charged with possession of an offensive weapon.

The Crown alleges that, Robinson and Ashmeade allegedly stole floor polish, dishwashing liquid, fabric softener and bleach, along with two boat engines. The items are reportedly valued at $321,500.

The attorney representing both men urged Senior Resident Magistrate Judith Pusey to be lenient and grant a non-custodial sentence.

“They have accepted responsibility for what has transpired. They have never been in trouble with the law,” he said.

However, Pusey expressed a different view, arguing that the men should be sent to prison.

“They are a number of small businesses struggling to survive, and they chose to pilfer. They must feel the sweet taste of the law,” she said.

The RM fined both men and ordered that Ashmeade pay $4,000 for possession of a knife.

British drug mule fined after almost dying on Caribbean flight

HAMILTON, Bermuda, Wednesday July 2, 2014, CMC - A 48-year-old British drug mule, who feared he was dying after swallowing more than half a pound of cocaine while flying from Antigua to London, has been fined US$800 in a Bermuda court.

The fine was imposed by Senior Magistrate Archibald Warner on Colmin Smith after he pleaded guilty on Tuesday to possession of a controlled drug.

Smith lost consciousness aboard the Virgin Airlines flight on May 16 shortly after telling airline staff he had ingested a large amount of cocaine and believed one of the pellets had opened inside his stomach, forcing the jetliner to make an emergency landing in Bermuda, Magistrates’ Court heard.

After being taken to the King Edward VII Memorial Hospital, government analysts determined Smith had ingested a total of 61 pellets containing 239.39 grams of cocaine. The drug was found to have a purity of 73 per cent and carried a street value of US$68,250, prosecutor Takiyah Burgess told the court.

Warner told Smith he was lucky to both be alive and to only be charged with possession of a controlled drug, which carries a maximum penalty of $1,000.

Smith said he thought death was inevitable, thanking God and the quick thinking of the plane’s crew for being alive.

“After I informed the flight attendant, in my mind, I died,” said Smith, who lives in Birmingham in the English Midlands. “I felt the death coming.”

Warner told Smith “I guess you are lucky, but there are other technical reasons for why you’ve been charged with this but let’s put it down to luck. You should thank whoever you worship or look to, because you are really lucky.”

Warner said Smith could also count his blessings for landing in Bermuda.

“You didn’t go to the first heaven but you came to the second heaven,” he said.

Smith agreed, adding: “I’ve met a lot of nice people here.”

If Smith fails to pay the US$800 fine he faces 80 days’ he faces imprisonment.

After making restitution for stealing over $300,000 from her employer the Jamaica National Building Society, Tamra McCaulsky was fined a total of $120,000 in the Corporate Area Resident Magistrate’s Court Monday.

McCaulsky, 33, from Portmore, St Catherine, was an Administrative Clerk at the bank. she was charged with two counts of larceny as a servant.

Her attorney, in a bid to get a reduced sentence, told the court that McCaulsky, “acknowledged what she did was wrong and did not waste the court’s time. She was arrested on February 13 and pleaded guilty on March 7, she also made restitution and she is the mother two”.

Senior Resident Magistrate Judith Pusey stated, “A person who steals to maintain a lifestyle should go to prison. When a person steals to maintain a lifestyle, it is wrong.”

RM Pusey fined her, $50,000 for the first count of larceny as a servant, $30,000 for the second count, $20,000 or six months for unauthorised access to computer data and another $20,000 or six months for making unauthorised transactions.
