Bobby Shmurda Pleads Not Guilty To Gun, Drug Charges

NEW YORK (AP) — An up-and-coming rapper pleaded not guilty on Thursday to charges he moonlighted as a gun-toting member of a New York City street gang responsible for several shootings during turf wars over drug trafficking.

Ackquille Pollard, who performs under the name Bobby Shmurda, was ordered held on $2 million bail at a hearing in state Supreme Court in Manhattan. His attorney, Howard Greenberg, failed to convince a judge that his client should be released without bail because he was framed and had no reason to run.

“He is a legitimate entertainer,” Greenberg said. “He is rich. He is busy. He is always on tour.”

The Brooklyn-born Pollard is best known for the hit song “Hot Boy.” He also put out a music video that popularized a dance craze called the “Shmoney dance,” and reportedly signed a lucrative record deal with Epic Records.

Greenberg claimed Epic had agreed to help Pollard make bail. A spokesman for the label declined to comment.

Police arrested Pollard on conspiracy, reckless endangerment and gun possession on Wednesday after he left a recording studio near Radio City Music Hall. Police found two handguns and a small amount of crack cocaine in a car in which he was riding, authorities said.

An indictment naming Pollard charges more than 15 defendants with a variety of crimes including murder, attempted murder, assault and drug dealing. The gang’s gun play left one rival dead, injured an innocent bystander sitting on folding chair outside a Brooklyn home and caused pandemonium outside a nightclub in Miami Beach, Florida, authorities said.

Police seized 21 guns during the investigation, 10 of them while making arrests on Wednesday.

The case carries some “deeply disturbing themes: The gang members’ enthrallment with guns, and a cavalier disregard for human life,” Special Narcotics Prosecutor Bridget Brennan said at a news conference.

The hip-hop artist’s songs and videos were “almost like a real-life document of what they were doing on the street,” added James Essig, head of a New York Police Department unit that made the arrests.

The court papers allege that Pollard fired a gun toward a crowd of people outside a barbershop in Brooklyn earlier this year. They also say he was present last year during a confrontation between rival drug gangs outside a Brooklyn courthouse where shots were fired.

The evidence includes several recorded phone conversations, including some between Pollard and gang members serving time on Rikers Island, the indictment says. The gang used code words, referring to firearms as “tone,” ”socks” or “CDs,” narcotics as “crills,” and shootings as “sun tans,” it says.

During a conversation on April 28, Pollard bragged, “I am two socks Bobby right now,” the indictment says. Another defendant commented, “Bobby out here with two CDs on him like in the wild wild west or something.”

A “Hot Boy” video posted on YouTube in August has been viewed tens of millions of times, and Pollard performed the song for a national television audience this month on “Jimmy Kimmel Live.”

“My music is straight facts,” Pollard recently told New York Magazine. “There are a lot of gangsters in my ‘hood.”

Pollard’s criminal history included two arrests for gun and drug possession, authorities said. If convicted of conspiracy, he faces a maximum sentence of 8 to 25 years in prison.

A teenage boy has been found guilty of shooting his 15-year-old girlfriend dead after she went to give him a birthday present.

Shereka Fab-Ann Marsh died after a single bullet from a counterfeit 1930s Italian Beretta pistol struck her in Hackney, east London, in March.

The boy, 15, was cleared of her murder but found guilty of manslaughter.

He was also found guilty at the Old Bailey of possession of a firearm with intent to endanger life.

In March, Shereka had gone to give the boy a birthday present, the court heard.

After the shooting the boy called 999 but Shereka had suffered serious internal bleeding and could not be saved, jurors heard.

Following the verdict, in a victim impact statement, Shereka’s mother Shyrine Mills said: “Shereka’s life was tragically cut short because of the negligent actions by one of her peers who took it upon himself to involve himself in activities that no child should ever be involved with.

“Guns are not toys and should only be handled by trained professionals in extreme circumstances.”

In court, the boy recreated the moment the incident happened, holding his hands together and pointing his fingers towards jurors from the witness box.

Under cross examination, he showed how he was holding the gun with both hands and “waving it” around when he “accidentally pulled the trigger”.

He denied that he was posing with the weapon and that was why he had to have his fingers on the trigger.

‘An accident’

The boy had insisted that he loved his girlfriend and had no reason to hurt her.

On his arrest at the house, the boy told officers it was “an accident” and exclaimed: “Am I going to hell?” and: “My girl died on my birthday.”

Officers went on to examine the boy’s mobile phone and found two pictures of him posing with handguns, one of which was pointing at the person who took the photograph.

A search of the boy’s bedroom uncovered a stab vest and body armour, but the boy said it was not his.

Jurors were told how the boy initially lied to police about how the shooting happened.

He claimed to have found the gun on Hackney Marshes but later admitted he had been given it to hide for a man in his 20s he refused to name.

It can now be reported that the gun which killed Shereka was “hot property”, according to prosecutor Jonathan Rees.

It had been used in a shooting in Finsbury Park the month before in which a car passenger was injured.

Man pleads guilty to criminal charges

A man, who sells condoms for a living, was sentenced to three months in prison when he appeared in the Corporate Area Resident Magistrate’s Court on Monday.

Pleading guilty to criminal trespassing and resisting arrest is 35-year-old Rohan Davy of a Kingston 20 address.

According to reports, on September 19 around 2 a.m., Davy was caught trespassing on the premises of a doctor’s office located on Ripon Road, Kingston 5. He was accosted by the police, but managed to wriggle his body away from an officer and ran.

The accused was held shortly after on Oxford Road in the area.

Davy told the court that he was in the Ripon Road area because he sells condoms to sex workers. He also admitted to Senior Resident Magistrate Judith Pusey that he has appeared before the court for a similar offence earlier this year.

“I explained to the other judge that I was tired and I drop asleep over there and she tell me be careful and fined me five grand,” he said.

“Well, I’m going to send you to prison for it. I know what you were doing over there and you know that I know what you were doing over there,” RM Pusey stated.

After RM Pusey handed down the sentencing, Davy pleaded, “I can’t just pay a fine Your Honour?”

He was sentenced to three months in prison for the criminal trespassing and 10 days in prison for resisting arrest, the sentences are to run consecutively.

Speaker thief on probation pleads guilty

A Yallahs man who was on a three-year probation for housebreaking and larceny, pleaded guilty to illegal possession of a speaker when he appeared in the Yallahs Resident Magistrate’s Court recently.

He returns to court for sentencing on October 24.

The case was that of 32-year-old Charles Murray of a Yallahs address in St Thomas, an area rampant with housebreaking and the theft of electrical and musical equipment particularly from churches.

The court heard that after a series of break-ins in the community the police secured a warrant to search Murray’s home based on intelligence and his track record. During the search the police found a silver speaker box which Murray said was given to him by his father.

However, when the police contacted the father he denied any knowledge of the equipment.

The convict was subsequently taken into custody and slapped with the charge of illegal possession of the speaker box on September 5.

The ‘Beautiful People’ hitmaker was sentenced to time already served by a judge after accepting a plea deal at a Washington DC Superior Court yesterday, where he was charged with misdemeanour assault for allegedly punching Parker Adams outside the W Hotel in October.

According to TMZ, the star apologised in court and said he wanted to get his music career back on track.

The singer’s bodyguard, Christopher Hollosy, was also accused of hitting Parker, who claimed he was struck after trying to get in a photograph with the Yeah 3X hitmaker.

Chris’ girlfriend, Karrueche Tran, was present at the Washington DC Superior Court to lend her beau some support.

The singer was released from jail on June 2 after spending 108 days behind bars for violating his probation after he allegedly made threats about using guns while seeking anger-management treatment in rehab.

He was previously placed on probation for five years and sentenced to six months community service for assaulting then-girlfriend Rihanna in 2009.

Last month, the star was praised by a judge for his good behaviour after appearing at a Los Angeles court for a progress report on his probation.

No bail for man who pleaded guilty to fraud

A man who pleaded guilty to fraud, but told the court that he is not a thief, was remanded in the Corporate Area Resident Magistrate’s Court yesterday.

Errol Robinson is to return to court on July 22, for sentencing.

It is alleged that the accused was entrusted with a 1992 motor truck to sell for a male complainant, however, he failed to turn over the money after the vehicle was sold.

“I am not a menace to society, I am not a thief. I am just a victim of circumstances. This situation makes me look like a thief, but I am not,” Robinson said in court when he was questioned about the complainant’s funds.

The accused is also to be sentenced in a similar matter where it is alleged that he sold a Mercedes Benz for a female complainant and failed to pay over the woman’s money.

British nationals plead guilty to cocaine smuggling

Two British nationals who reportedly attempted to smuggle liquid cocaine on a flight out of Jamaica last year will be sentenced in the Montego Bay Resident Magistrate’s Court today, after they pleaded guilty to the offence on Friday.

Twenty-nine-year-old Jaharie Silvera, a sales representative, and his 27-year-old cousin Rene Henriquez, both of London addresses, had initially pleaded not guilty to the charges of possession of, dealing in and attempting to export cocaine. However, they changed their plea to guilty last Friday, following which their case was set for sentencing today.

It is alleged that on May 11, 2013, at approximately 2:30 p.m., Silvera and Henriquez were seen at the Sangster International Airport, in Montego Bay, with travelling bags, which were searched by officers on duty at the airport.

Silvera’s bag was found to contain 10 plastic bottles which had a green-and-blue liquid substance in them, while Henriquez’s bag had five bottles of a similar substance. Subsequent tests revealed that Silvera’s bottles had one pound and 13 ounces of cocaine in them, while Henriquez’s bottles had over 14 ounces of cocaine. Both men were arrested and charged.

Attorney-at-law Ernie Smith, who is representing both men, asked Resident Magistrate Wilson Smith to be lenient in sentencing them, as they had been tricked into carrying the contraband.

“It is clear that they are neither drug users nor dealers, but they were tricked by a combination of friends and relatives, because they had only come to Jamaica to visit distant relatives, and they were both asked to take back gifts for other persons. They were asked to take back therapeutic liquid soap,” said Smith.

“They have thrown themselves at Your Honour’s mercy, this is a case in which Your Honour could favourably consider not imposing a custodial sentence,” he added.

“I will pass sentence on the 7th of July. Their bails are extended,” replied RM Smith.

Trinidad man found not guilty of leaking 2008 CXC exam papers

CXCPORT-OF-SPAIN, Trinidad, Tuesday July 1, 2014, CMC – A 26-year-old man has been found not guilty of two charges of illegally obtaining examination papers of the Barbados-based Caribbean Examinations Council (CXC).

Magistrate Lisa Ramsumair-Hinds, sitting in the San Fernando Magistrate Court, Monday dismissed the charges against Mikquel Torres, who had been charged with unlawfully procuring the May/June 2008 CXC Mathematics and English examination papers.

Torres, who did not testify in a trial, had earlier pleaded not guilty. He had been on one million TT dollars bail (One TT dollar =US$0.16 cents) after he was charged with the offences on May 22, 2008.

Torres was among several people charged with procuring examination papers relating to the 2008 CXC examinations. These matters were all dismissed last year.

In 2008, more than 20,000 pupils had to re-sit the Mathematics and English examination which were rescheduled because of the leaked papers.

Witnesses from the CXC and the Ministry of Education as well as two police officers testified during the trial.

Torres’s attorney had made a no case submission but the magistrate overruled the submission. However she said the prosecution had failed to prove the case beyond a reasonable doubt.

The jail was demolished in 2002, but the state has been slow to bring the perpetrators to trial Twenty-five police have been given long sentences for their part in the 1992 massacre in Sao Paulo’s Carandiru jail that left 111 prisoners dead.


Each officer received 624 years for the death of 52 inmates, but in Brazil no-one serves more than 30 years in jail.


The verdicts come in the second of four stages of the trial involving different floors of the prison. Twenty-three officers were convicted in April.


The police are expected to stay free pending an appeal.


The defence can only challenge the verdicts after the end of the whole trial, expected in January 2014.


Under Brazilian law there are no life sentences, and no convicted person can serve longer than 30 years in jail.


The officers, nine of whom are still on active duty, will also lose their jobs, O Globo newspaper reported.


The riot began on 2 October 1992 after an argument between two inmates quickly spread, with rival gangs facing off in what was at the time one of South America’s largest prisons, housing 10,000 inmates.


Inmates said riot police brutally repressed the riot.


The officers’ lawyer, Ieda Ribeiro de Souza, argued they were only doing their duty and acted in self-defence, as many of the inmates were armed.


While prison riots are not uncommon in Brazil, the number of those killed at Carandiru and the slow pace of the Brazilian justice system in bringing the accused to trial shocked the public.


Carandiru was closed in 2002, shortly after inmates co-ordinated simultaneous uprisings in 27 jails across Sao Paulo state during which thousands of visitors were held hostage.


In 2001, Col Ubiratan Guimaraes, who led the police operation to regain control in Carandiru, was convicted of using excessive force. But he was acquitted on appeal in 2006.

In exchange, prosecutors are recommending the 53-year-old Castro be sentenced to life without parole plus 1,000 years.Castro says a pornography addiction and “sexual problem” have taken a toll on his mind. He also says he was sexually abused as a child.He had been charged in a 977-count indictment. He is pleading guilty to 937 counts.He had been scheduled for trial August 5 on allegations that include repeatedly restraining the women and punching and starving one woman until she had a miscarriage.The women disappeared separately between 2002 and 2004. They escaped from Castro’s house May 6.

NEW YORK (CMC) – The United States Immigration and Customs Enforcement (ICE) agency says a former New York Police Department (NYPD) officer has pleaded guilty to defrauding Caribbean and other immigrants. On Wednesday, the ICE said Miguel A Rodriguez, 53, committed the fraud by “conning immigrants seeking driver’s licenses and immigration assistance out of thousands of dollars.”Rodriguez pleaded guilty to the charge in Dutchess County Court in upstate New York.The guilty plea follows an investigation by ICE’s Homeland Security Investigations (HSI), the Wappingers Falls Police Department and the New York State Department of Motor Vehicles.According to the ICE, Rodriguez carried out the scheme while serving as a police officer and a liaison to the Latino community in the Village of Wappingers Falls in upstate New York.Under the terms of his plea agreement, Rodriguez is expected to be sentenced to one year imprisonment and to be subject to an order of restitution in the amount of US$13,862.Special agent in charge of HSI New York, James T Hayes Jr, said Rodriguez was “entrusted to serve the community but instead he robbed thousands of dollars from the very people he was sworn to protect.“He preyed upon the necessity and hope of individuals seeking immigration assistance and legitimate government documents,” he said.Rodriguez told the court that between October 2010 and August 2012, he charged Caribbean and other immigrants US$300 each to enter a state lottery which he claimed could garner them valid New York State driver’s licenses.He admitted to charging victims US$500 to US$1,000 for “asylum and withholding of removal” applications, falsely promising that the applications would be reviewed by an attorney and filed with the appropriate immigration authorities – “without even determining whether the victims could be eligible for the immigration benefits at all.”As part of his fraudulent scheme, the ICE said Rodriguez visited religious congregations and preyed upon unsuspecting churchgoers, portraying himself as a compassionate individual with official connections to help them get driver’s licenses and other services.Like our Facebook page https://www.facebook.com/jamaicaobserverFollow us on Twitter https://twitter.com/JamaicaObserver
