PNP national executive member on fraud charge returns to court

KINGSTON, Jamaica – People’s National Party (PNP) member Donovan Bisasor and a co-accused arrested in August for fraud will again appear in the Corporate Area Resident Magistrate’s Court today.

The 58-year-old Bisasor and his 31-year-old co-accused Jesse Gosse were both offered $1.5-million bail on their first appearance in court, on August 19.

Bisasor, who sits on the ruling party’s National Executive Council, is accused of trying to defraud the State-owned National Water Commission of $5 million.

Bisasor, an engineer who hails from Cherry Gardens in Kingston, and quantity surveyor Gosse, of Richmond Park are charged with attempting to obtain money by false documents, forgery, uttering forged documents, conspiracy to defraud, and demanding property on forged documents.

It is alleged that in January 2011 the National Environment and Planning Agency (NEPA) served an enforcement notice on the NWC in respect to Barnes Gully, resulting in the company having to carry out an emergency procedure. As a result, a contract was allegedly awarded to XYZ Construction Company for $27.4 million with $2.3 million for security.

However, on completion of the project Bisasor allegedly told NWC that the money for security was insufficient and was instructed to provide documents to substantiate his claim.

It is further alleged that on August 15, 2011 Goss submitted a claim for $7.3 million for services provided by Secure Security Limited. However, checks made with the security company allegedly revealed that it was never contracted to work on the project.

Schoolboy face court on ammo charge

A 15-year-old schoolboy from a prominent high school in central Jamaica, is now awaiting his day in court after he was charged by the police for the possession of one round of ammunition.

The boy, who is to appear in court on October 7, is a fourth form student who lives with his 14-year-old brother in Trelawny. THE STAR learnt that their father abandoned them more than a year ago, when their mother left to live in the United States.

According to the police, the boy brought the ammunition to school last week to threaten another student who was reportedly provoking him.

It is understood that the ammunition was found after the student the boy threatened reported the matter to a security guard at the school. The boy was then searched and the ammunition found on his person. The police was then called in and the boy arrested.

THE STAR learnt that when the boy was asked by the police where he got the round of ammunition he reportedly said he found it on the street. He was then charged with illegal possession of ammunition and then bailed to a responsible guardian.

A man who allegedly wounded the mother of his child after she asked him for money to purchase back-to-school expenses for his child, had his bail extended when he appeared in the Santa Cruz Resident Magistrate’s Court on Monday.

Neil Harris, of a St Elizabeth address, is charged with unlawful wounding.

It is alleged that, on August 18 at approximately 12:15 p.m., the complainant, who has a child with the accused, went to see him in New Holland to ask for help with back-to-school expenses.

A disagreement developed and Harris allegedly pushed her to the ground causing damage to her hand. He reportedly used a glass bottle to cause damage above one of her eyes.

Harris is set to reappear in court on November 24.

Policeman on corruption charge gets bail

A policeman, alleged to have taken a bribe, was hauled before the Corporate Area Resident Magistrate’s Court yesterday.

Charged with breaches of the Corruption and Prevention Act is Leandrew Coley, who was offered bail in the sum of $200,000.

The Crown alleges that Coley, a serving member of the Jamaica Constabulary Force, accepted $2,000 from a motorist on July 13, 2013. On that day, Coley and other officers were on duty patrolling in the Waterhouse community in St Andrew, where it is alleged that the accused signalled a motorist to stop.

The driver was approached by the accused and was allegedly offered money not to prosecute him for traffic violations. Further allegations are that the accused bought drinks for friends.

A report was made to Coley’s superiors and he was charged.

He is to return to courton November 3.

THE Portmore police have reported that Okeelie Brown, one of two men killed last Monday during a shoot-out with lawmen on Winona Drive, Garveymeade, was a gang member charged in 2010 with the double murder of former Waterford High School goalkeeper, Okeeffee Lewis, and his stepfather, Leonard Hamilton.

The police claim Brown and another man, Dadrian Davis, were killed when the lawmen went in search of them after receiving information that they had pulled weapons on a visitor to the Garveymeade community.

Brown was also reportedly wanted by the police for the shooting of a rival gang member, ‘Headless’, earlier this month.

“A report was made to the police that men had accosted the visitor, enquiring about his reasons for being in the area. Based on information, a special team went in search of the men. They were spotted and engaged the police in a shoot-out,” a police source told THE STAR.

Two firearms, a .38 pistol, with two rounds of ammunition, and .45 colt pistol, were seized during the shoot-out.

Brown, the police claimed, was second in command of the notorious Umbrella gang, said to be responsible for 31 murders in the Newlands area and elsewhere in Portmore from 2006 to 2011.

He, however, had fallen out of favour with the outfit’s incarcerated leader and left to form his own gang, operating out of Garveymeade.

Brown and four other members of the Umbrella gang were charged with the November 16, 2010, double murder of Lewis and Hamilton in Newlands, which plunged Waterford High into mourning on the eve of the Manning Cup semi-finals.

Former Justice of the Peace Roy Stevenson, who is charged with making a false declaration, is to stand trial on January 15 next year.

When the case was called up in the Spanish Town Resident Magistrate Court last Thursday, it was revealed that the file is now complete as a statement from the Ministry of Justice has been secured.

Attorney-at-law Lancelot Clarke Jr, told the court that the defence is ready for the trial.

Allegations are that Stevenson signed documents stating that he knew persons who were securing bail for a man. It was revealed that the accused failed to attend court and a warrant was issued for his arrest.

Investigations later revealed that the name of a dead person was used a surety.

Further checks revealed that the JP did not know the person for whom he was signing the documents. Following investigations he was charged. He has made numerous court appearances and maintained his innocence throughout.

Woman on stabbing charge gets bail extension

A mentally ill woman accused of stabbing two church brothers had her bail extended when she appeared before the Corporate Area Resident Magistrate’s Court yesterday.

Charged with unlawful wounding is 34-year-old Simone Allen of a Kingston address.

Allen, who appeared in court with her father, was reportedly taken into custody by the police in February after having a brief confrontation with both complainants. The accused allegedly caused a disturbance at the church resulting in members denying her entry to the building. As a result, she is alleged to have used a knife to stab both complainants causing injuries.

Allen, who was previously housed at a penal institution, was moved to a mental institution following results from a psychiatric evaluation previously ordered.

“Miss Allen, you taking the medication?” Senior Resident Magistrate Judith Pusey asked the complainant, to which she responded with a nod.

“Mi go over to the church to tell them that I’m sorry,” said a remorseful Allen.

The court heard that the accused has three sons and one of them is now being cared for by members of the church. Allen stated that she has since been prevented from seeing her child as a result of the incident. She also stated that she had returned to the church recently, begging for forgiveness.

The sitting magistrate beseeched that she be able to see her son.

“No, don’t go back down there, but she must be able to see her child!” RM Pusey remarked. “Because is insanity, nuhbody nuh want have nothing fi do with her. Insanity is the kind of thing that yu nuh have control over it, yu nuh,”

Subsequently, Allen had her bail extended for her to return to court on July 24 for a mention hearing.

By the end of the proceeding, an interesting turn of events resulted in one of the male complainants embracing Allen in what appeared to be a genuine act of pardon, declaring “I forgive you, I forgive you!”

A policeman accused of beating the aunt of a teenager he is accused of raping was remanded when he appeared in the Spanish Town Resident Magistrate’s Court on Wednesday.

He is Constable Andrew Thomas, 28, from the Morant Bay Police Station in St Thomas.

When the matter came up in court, Thomas’ lawyer made a strenuous bail application which was denied by the court. He was subsequently ordered remanded until July 29, 2014, when the matter again will be mentioned.

The policeman’s appearance in court arose from an incident in St Catherine where he was said to have sexually assaulted a 17-year-old girl who is reportedly the niece of his common-law wife.

The child reportedly related her ordeal to her aunt and the accused lured the woman to a section of Eltham in St Catherine where he was said to have beaten her.

Reports are that three tyres were placed over her and then he threw a liquid substance all over the tyres.

He reportedly struck a lighter and attempted to set her ablaze, however, she was spared after begging him to spare her.

A subsequent report was made followed by an investigation and a ruling was handed down by the Office of the Director of Public Prosecutions that he be charged with rape and attempted murder.

Man on arson charge granted bail

A man who set fire to a bed in his house following a domestic dispute was granted bail when he appeared before the Corporate Area Resident Magistrate’s Court on Tuesday.

Charged with arson is 48-year-old farmer Shawn Tucker of Bloxburgh district, St Andrew.

Allegations are that on June 23 at approximately 6 a.m., Tucker and the complainant, who is his wife, had an argument during which the accused allegedly began removing items of clothing, among other things belonging to the complainant, from their home. It is believed that Tucker then used a cigarette lighter to set fire to a bed inside the one-bedroom board structure, thereby totally destroying the dwelling.

It is believed that when cautioned by officers who were called to the scene, Tucker said: “Offica, mi nuh bun down nuh house, a di woman sister dem bun dung mi house and fling stone after mi.”

Subsequently, Senior Resident Magistrate Judith Pusey granted the accused man bail in the sum of $80,000 with surety, ordering him to return to court on July 30. A fingerprint order was also made.

Accused on assault charge gets bail extended

A man accused of assaulting his girlfriend had his bail extended when he appeared before the Corporate Area Resident Magistrate’s Court recently.

Charged with assault occasioning bodily harm is Raphael Wilson.

On the day in question, it is alleged that Wilson punched the complainant, who is his girlfriend, all over her body and in her face.

Wilson, however, insisted that the complainant fabricated the entire account, later filing a false report to the police.

Senior Resident Magistrate Judith Pusey ordered the accused to return on July 25 for a mention hearing, pending an outstanding medical report. A fingerprint order was also made.

31 January 2014 Last updated at 19:50 ET A barge is loaded with coal in Santa Marta: the practice is now illegal in Colombia Colombian chief prosecutor Eduardo Montealegre says he will bring charges against six employees of the US coal mining company, Drummond, over an environmental disaster last year.

The company spilled hundreds of tonnes of coal into the sea at Santa Marta, on Colombia’s Caribbean coast, when it tried to rescue a sinking barge.

Drummond said it regretted what it described as “an industrial accident”.

The company had been ordered to pay a $3.5m (£2.1m) fine.

The accident happened in January 2013.

Drummond says on its website that one of its barges loaded with coal “took on water overnight due to high wind and wave conditions”.

In the operation to rescue the barge, crane operators ended up dumping tonnes of coal into the sea.

The six employees being charged include onsite supervisors and crane operators.

Earlier this month, Colombia banned the use of cranes and barges in all its ports.

The rules are aimed at preventing spillage and sea pollution.

Environment Minister Luz Helena Sarmiento ordered the Alabama-based company to stop loading coal until it complies with new environmental rules.

The company is building a new conveyor belt loading system that complies with the legislation. It is expected to be operational in March.

In the meantime, the ban is expected to affect Colombia’s coal exports.

The South American nation is the world’s fourth coal exporter, and Drummond accounts for 30% of that total.

Teen on manslaughter charge granted bail

ST ANN, Jamaica — A teenager facing manslaughter charges following the death of a 53-year-old woman in St Ann, on January 11, was offered bail when he appeared in the St Ann’s Bay Resident Magistrate’s Court on Thursday.

Eighteen-year-old Ryan Jackson was offered bail in the sum of $450,000. As a condition of his bail, Jackson will have to report to the Watt Town Police Station three times weekly.

The matter will again be brought before the court on April 16.

Reports are that on Saturday, January 11, Jackson drove away a Mitsubishi Pajero SUV from a car wash where he worked near White River, Ocho Rios, without the consent of the vehicle owner or business operators. He then lost control of the vehicle reportedly slamming into a Nissan van heading in the opposite direction.

Joy Reid, who was a passenger in the van, died from injuries sustained in the crash. Her common-law-husband was hospitalised in serious but stable condition.

It was revealed that Jackson does not have a driver’s licence and that the vehicle he was driving belonged to an employee at a nearby hotel.

The owner had left the vehicle at the facility to be washed and was expected to return Saturday night for pick up.

Chile judge rejects Matthei charge

5 August 2013 Last updated at 21:08 ET The two generals’ daughters, Evelyn Matthei (left) and Michelle Bachelet, are rivals in November’s election A Chilean judge has rejected a request by a human rights lawyer to prosecute former Gen Fernando Matthei for murder.

Gen Matthei was the director of a military facility where Gen Alberto Bachelet was tortured to death months after the 1973 military coup.

Their daughters – Evelyn Matthei and Michelle Bachelet – are running against each other in the November presidential election.

“There are no grounds for the requested prosecution,” said judge Mario Carroza.

Human rights lawyer Eduardo Contreras argued that there was new evidence showing that Gen Matthei knew about the death of Gen Bachelet.

Michelle Bachelet’s father refused to back the military coup led by Gen Augusto Pinochet and was accused of treason.

He died in prison after being submitted to systematic torture.

‘Family friends’

This is Mr Contreras’s second attempt to have a case opened against Gen Matthei.

Mr Contreras, who represents the families of victims of the Pinochet regime, says he will appeal.

Gen Matthei’s lawyers argued that he took over the military facility after the death of Gen Bachelet.

The 88-year-old general has not spoken publicly about the case.

Evelyn Matthei was chosen last month to run against former left-wing president Michelle Bachelet in the 17 November poll.

Ms Bachelet is leading opinion polls to succeed centre-right President Sebastian Pinera.

If she fails to get 50% of the vote in November, a runoff will be held on 15 December.

The incident reportedly took place after his daughter visited him at his Greenvale home in Manchester. The man was on bail in another sexual offence charge at the time of the incident involving his daughter.Late last year the taxi driver who plies the Greenvale to Mandeville route was charged for the rape of a 12-year-old girl reported to be his goddaughter. KINGSTON, Jamaica — The Independent Commission of Investigations (INDECOM) has the power of arrest and charge, a judgment handed down in the Constitutional Court said Tuesday morning.The judgment further states there is no requirement for a ruling from the Director of Public Prosecution (DPP) before an officer is arrested and charged, and that powers possessed by the Commission to arrest and initiate prosecution does not undermine the DPP.INDECOM was established to investigate shootings by the Jamaica Constabulary Force and the Jamaica Defence Force.The ruling is a major victory for INDECOM in the matter brought before the Courts by the Jamaica Police Federation (JPF), the Police Officers’ Association, the Special Constabulary Force Association, and the United District Constables’ Association. The JPF and police representative bodies sought a declaration as to whether or not the Commission had the powers to arrest, charge and to initiate prosecutions with or without a ruling from the DPP. The court, comprising Justice Horace Marsh, Justice Lennox Campbell and Justice David Fraser, handed down their judgment in the Constitutional Court which held that the Commission’s staff has by virtue of common law and statue, the power to arrest, charge and initiate prosecution. The statutory power stems from Section 20 of the INDECOM Act which grants like powers, authorities and privileges to the Commissioner and his investigative staff as those given by law to a constable. ST ANN’S BAY, St Ann — A St Ann Victim Support Unit coordinator facing a sexual relation charge was remanded in custody when he appeared in the St Ann’s Bay Resident Magistrate Court on Friday, June 28.Thirty-nine-year-old Lincoln Dennis of Moneague, St Ann was reportedly charged by the Centre for Investigations of Sexual Offences and Child Abuse (CISOCA) with sexual touching of a child on Tuesday, June 25.Dennis who operates under the Minister of Justice counselling arm was allegedly asked earlier this year to counsel the child, when the incident occurred.The child is said to be under 16 years old; the sex of the child has not been revealed.The accused will reappear in court on Tuesday, July 2.
